Recently, Sean represented an owner facing absolute liability under the New York Labor Law for injuries sustained by a sub-contractor's employee who fell from a ladder on the client's property. Sean obtained summary judgment against the general contractor, which resulted in the client's exposure being transferred to the former. Summary judgment was obtained based upon the indemnification provisions of the contract between the parties even though the client's name did not actually appear in the contract itself. To accomplish this, he had to eliminate any question of fact as to the intent of the parties as well as establish that the client did not exercise any supervision or control over the injured worker or the methods by which the work was performed.
