The world of personal injury litigation is being turned upside down by a major legislative change. This change is having a profound impact on carriers, self-insureds, and attorneys alike. Effective January 1, 2010, the reporting of settlements, judgments and awards of any case involving a Medicare eligible individual commenced. The reporting requirement is intended to give teeth to the long since established Medicare Secondary Payer provision of the Medicare Act.
