Maureen Casey, a Partner and Senior Trial Attorney in the firm's Albertson office, has over ten years experience defending school districts on Long Island in a variety of general liability matters including claims of negligent supervision of students in gym class, during recess and while participating in extracurricular sporting activities.  In defending school districts, she also handles premise liability claims involving trip and fall accidents.

The defense of assault cases are of particular interest to Maureen and she has handled a range of cases of this type including student fights, sexual assaults, and an AIDS phobia case involving a student cut with a lancet by another student during a blood typing exercise in a high school biology class.  She recently defended a school district in a case where the plaintiff claimed to have contracted herpes during varsity wrestling practice.

In 1997, she authored School District Liability for Assaults on Students for the Spring edition of the Defendant.

The Court of Appeals recently affirmed a grant of summary judgment to the school district in a case involving a second grade student who fell from a cargo net during gym class breaking her arm.  Maureen worked with her partner, Brendan Fitzpatrick, who heads up the firm's Appeals Unit, in preparing the briefs. Brendan argued the appeal.  In its decision the Court took the opportunity to reiterate the standard of care of a reasonably prudent parent under comparable circumstances.  The Court then examined the expert opinion offered by plaintiffs in support of their negligent supervision claim.   The Court held that, absent a foundation or source of the standards underlying the expert's opinion that supervision was inadequate, the opinion lacked probative value.
